Texas Motorcycle Crash Injury Lawyers

Over the last ten (10) years, motorcycle registrations have increased significantly. More and more consumers are choosing to ride motorcycles. Motorcycle popularity is definitely on the rise. Why is this? Well, riding is fun! Moreover, due to the increasing push to save resources and be more environmentally conscious, consumers are turning to motorcycles as their primary means of transportation. At a time when most passenger vehicles average around 25 miles per gallon, motorcycles can average around 50 miles per gallon.

Sadly, the increase in motorcycle sales has coincided with a significant increase in motorcycle-related injuries and deaths, which have dramatically risen over the last few years. The National Highway Traffic Safety Administration (NHTSA) estimates that 4,000 deaths and 76,000 injuries each year in the U.S. can be attributed to motorcycle collisions. Although Texas has spent considerable time in educating the motor vehicle driving public to “Share the Road,” ever increasing numbers of motorcycle collisions are occurring. Many motor vehicle operators simply fail to adhere to simple rules of the road. They are blind to the motorcycle. When motor vehicle operators fail to adhere to traffic laws, crashes can occur. Considering the nature of motorcycle/motor vehicle collisions, the operator on the motorcycle often suffers significant injury mechanism during a crash, including head trauma, spinal cord injury, and other catastrophic personal injuries.

The attorneys at The Stewart Law Firm are familiar with the rules of road and remain steadfast in the pursuit of justice for motorcycle crash victims. The Stewart Law Firm understands the severity of Texas motorcycle crashes and the life-changing effects that can occur as a result of a crash caused by the negligent acts of another. In an effort to make Austin streets and roadways safe, the Austin Police Department will revive its “no-refusal” policy. If a suspected drunk driver is pulled over by APD on a suspicion of drunk driving and refuses to perform a breath-test, the suspected drunk driver will be placed under arrest and blood will be drawn pursuant to a court order. In an effort to deter drunk driving crashes, APD officers will be patrolling all major and many minor roadways in the community over the weekend.

The Stewart Law Firm sees, all too often, how victims of drunk drivers are impacted. Many times, victims can be catastrophically or fatally injured. OSHA Cites Texas Grain Company for Safety Violations

According to the U.S. Department of Labor's Occupational Safety and Health Administration (OSHA), it has cited Corpus Christi Grain Co. in Corpus Christi, Texas for six willful and 20 serious violations with total proposed penalties of $258,900. OSHA's Corpus Christi Area Office initiated its inspection at the company's facility after it was reported that a worker was engulfed while emptying grain from a storage bin. The employee was rescued. "Employees working in grain storage buildings are exposed to dangerous conditions, and proper safety measures must be taken," said Michael Rivera, director of OSHA's Corpus Christi office. "If OSHA's standards were followed, it is possible this unfortunate incident could have been avoided."

Under the Occupational Safety and Health Act of 1970, employers are responsible for providing safe and healthful workplaces for their employees. OSHA's role is to ensure these conditions for America's working men and women by setting and enforcing standards, and providing training, education and assistance. Pennsylvania Passes Strong Teen Driving Law

According to a press release, the National Transportation Safety Board NTSB) commended Pennsylvania Governor Tom Corbett and the Pennsylvania General Assembly for strengthening the State's teen driving law. The new provision prohibits a junior license holder from carrying more than one passenger under the age of 18 for the first six months after issuance of the license, unless he or she is accompanied by a parent or guardian. The law also makes it a primary offense when drivers and passengers under age 18 are not wearing a seatbelt or buckled in a child safety or booster seat. According to the NTSB, lawmakers in Pennsylvania have taken a major step in reducing tragic teen highway fatalities, according to NTSB Chairman Deborah A.P. Hersman. According to reports, motor vehicle crashes are the leading cause of death for teenagers.

Halloween Safety Tips

Halloween is here. Neighborhoods will literally be crawling with all kinds of creatures and goblins as they all work to fill candy bags. Children participating in Halloween festivities represent a real safety concern for drivers. Studies show that the number of fatal injuries among young pedestrians is 4 times higher on Halloween than any other night of the year. Collisions between motor vehicles and child pedestrians happen most frequently between the hours of 4 p.m. and 8 p.m. Texas law requires that motorist use all due care in operating their motor vehicles when young people are present on or near a roadway. It is reasonable to expect that young children will simply not appreciate danger that might exist with motorists. Under the law, it is incumbent on motor vehicle operators to drive with care and use proper caution. This is especially true on Halloween, a time that all motorists should recognize that youngsters will be on the streets.

Halloween Safety Tips:

-Know where Halloween celebrations will be taking place in your neighborhood.

-Add reflective tape to costumes and provide flashlights so that your trick-or-treaters are clearly visible to motorists.

-Make sure that costumes allow your child an obstructed ability to see in all directions.

-Motorists should operate their motor vehicles well below the posted speed limit. Be prepared to make emergency stops if necessary.

-Motorists should stay completely focused. Avoid cell phone use and other distractions.

-Never assume that a young pedestrian will yield to your vehicle. Children may not see or appreciate the danger of a vehicle.

-If you are backing your vehicle, make sure that there are no children behind you. Numerous children are injured or killed by backing vehicles.

Texas Crime Victims' Compensation Fund Benefits

Many Texans are unaware that crime victim compensation is available through the State of Texas. In 1979, the Texas Legislature passed the Crime Victims’ Compensation Act, creating the Texas Crime Victims’ Compensation Program. Revenue for the Texas Crime Victims Compensation Fund is collected from convicted offenders through criminal court costs, fees, and fines. The fund is administered by the Office of the Attorney General and is dedicated to ensuring that victims of crime are provided financial assistance for crime-related expenses that cannot be paid by insurance or other sources. Presently, claims may be approved for benefits up to $50,000.00. Individuals who suffer total and permanent disability and related expenses may qualify for an additional $75,000 benefit. These benefits can include expenses related to medical care and lost wages.
